Wednesday April 11, 2007, at 9:30 a.m. in US District Court in Greensboro, North Carolina  we will be having a hearing before Magistrate Judge Sharp regarding our request for a preliminary injunction.  We have requested that RegisterFly immediately release all domain names, allowing them to be transferred to a new registrar.  However, since we believe that RegisterFly may be on the verge of shutdown, we are also moving for an immediate injunction, asking the Court to order that RegisterFly turn over all data to ICANN, so that information still “trapped” will be safe when RegisterFly inevitably crashes completely.

While the hope is that the Court will grant an injunction requiring the release of all domain names, and that RegisterFly will comply… data escrow may, at least, protect you from permanent loss of ownership, even if we are unable to get RegisterFly to release domains without further court action.  This is an inadequate remedy at best for those still trapped, but we hope to get the parties moving toward a resolution. 

If you live anywhere nearby, and can possibly make it, please join us in the courtroom. I know many of you live far away, even in distant countries, but I will be fighting for you whether you can be present or not. Thank you all for registering to become a part of the class action lawsuit against RegisterFly, ICANN, and eNom.  We are not yet at the stage for the Court to certify the case as a class action, so for now, you have just registered to be part of the case when it is certified.

While many of you are eager for more information, and you may have your domain trapped and your livelihood in danger (as Anne Martinez), I will only be updating you when I have actual news to give you.  I promise I will not be flooding your mailbox with unwanted spam. avatar Magistrate Judge Sharp just granted ICANN's Motion to continue the hearing from tomorrow April 11th 2007 to an undetermined date. Lawyer Clarke Dummit has been working hard compiling affidavits and evidence of ongoing fraud in the Registerfly matter. He plan's on preparing a new request for the court. The motion by ICANN will most likely delaying the protection of the Registrant's.

I can confirm that while retrieving codes at 1pm EST today, Registerfly stopped responding. about once in every 11 login attempts I can pull up the host page, but there is no response from the domain management section. 49 minutes of continued attempts.

Even the government of Thailand became a victim and U.S. authorities such as FBI or the police allow Medina and his mobster to trap more clients with their still functional website.

Is there no more law in the U.S.

Better give that ICANN domain biz to countries with a regular law system. The U.S. and ICANN have established themselves as fully useless.

Why doesn't someone from this Dummit Law Firm in NC approach the TV News Media like O'Reilly Factor. Bill O'Reilly is always saying how he's "looking out for you" so maybe if Bill puts some pressure on this judge in NC, something will happen. I mean after all, most of the people who are being harmed by this are "regular folks" as Bill would say.

Actually the Financial times are also excellent since they do Global business worldwide with papers serving all continents and this is certrainly their gloabl territory...Perhaps if the medai questions are in place....the why's of inaction, the why's of failed fedearl or other action....why the people have to wait for no action....whose role is primary and is this not local business or is it state..I say each individual state has control and interstate commerce laws on a grand larceny scale are in order./...or is it as it seemed a failed attempt at scripting that has left these guys' personal life naked on top of the pile below them?

Also, It is quite evident that Icanne needs to establish, with proof, the ability to overtake any domain holder's registration from the accreditted registrar's in such matter's as these , without the need for a court order,in the interest of the buiness holder's rights. Actually I do not see where they can't since the authority to do so prevails, meaning that they should be able to get a local Judge with paperwork, the ability to "completely remove the registrar from the business property that holds the domain holders' registration information"...meaning their place of business, just like a bank foreclosing on a property.

In other words, without accreditaion, or without permission for an activity as described by Icanne, then Icanne should be the ultimate Domian Holder, proxy, for any registered domain holder.
Any infringement on the Domain owner's rights would automatically remove that registration from the accredited Domain registrar.
Tha's actually the way I thought they were set up...but maybe they didn't make it so. Thats the way it sghould be without question.

I just got an email from ICANN (re transfer codes missing )saying my ticket is closed if you feel this is in error start again, I have been chasing for 4 months for 6 auth codes and nothing has happened, registerfly always just close the tickets, now ICANN give me the same response and still no Auth codes
