Unfortunately I was just called by the clerk's office this afternoon, and Magistrate Judge Sharp just granted ICANN's Motion to continue the hearing from tomorrow April 11th 2007 to an undetermined date.  I know this is bad news for so many of you who are still trapped, and it is one more breach by ICANN of their duty to protect the public.

I plan on filing a new request for an immediate TRO based upon the unfolding situation, however I cannot disclose the details at this time.  I have been compiling affidavits and evidence of ongoing fraud since the last hearing.   I am preparing documents to be filed soon.  I am continuing to fight for all of those who are still trapped.  I will keep you updated as the case unfolds. - Clark Dummit

Those domains that people can't renew through RegisterFly who didn't know this was going on, I thought ICANN had decided to keep those in trust? A site I visit that wasn't aware of the problems never got any notice and their domain was subsequently bought.

I'm not surprised at all.

ICANN can't help us, period. I never had any hope that ICANN will help save our domain(s).

You either get your domains out or lose them if you can't.

Having read through some of the documentation about the lawsuit it appears to me that the reason for the continuation is two-fold.

1) The lawsuit is being brought in North Carolina and ICANN and others have no connection to NC.

2) ICANN are already involved in a lawsuit or lawsuits in California with Registerfly and the outcome of that will affect the lawsuit brought in NC.

This means, in my un-tutored opinion, that ICANN have chosen where to fight their battle on the basis of legal precedents of the past.

I had 50 domains with Registerfly, none of which are due to expire anytime soon. When I attempted to transfer them a month ago (before I learned how to acquire the authorization codes), not only was I unable to transfer them, they disappeared from my Registerfly account. Support tickets, emails, faxes, and emails to compliance and icann have been futile.

If you feel any information I have would help you Clark, please let me know. I truly don't know what to do...
