Dummit Law Registerfly Class ActionWe have an update on the Registerfly Class-Action Lawsuit being pursued by Clarke Dummit and company at the Dummit Law Firm.  This is good news that Dummit has not forgotten us and is still pursuing this case against Registerfly.  Looks like the next step in the lawsuit will be a Questionaire and then each class participant will have to prove their losses.  This can be rather complicated due to the estimated value of domain names, losses of hosting, theft of money for services not rendered and every other loss incurred.  Please read on for the official notice.

I have promised not to flood your email with meaningless spam so I have waited until we had new information before contacting all of you.  RegisterFly, Kevin Medina, Hosting Services Group, Inc. and Unified Names, Inc. collectively never answered the original complaint; therefore, a tactical decision was made to file a Motion for Entry of Default Judgment against the four Defendants.  While we have moved for an entry of default, the issue of damages is still quite complex and requires quite a bit more discovery and research before we can present the Court with an assessment of the total harm caused by these defendants. 

While there are estimated to be a quarter million people harmed, the Dummit Law Firm is working to represent the entire class of harmed domain holders.  We have reviewed thousands of accounts, notes, and memoranda and has received many calls for other people who were similarly affected.  We are still assessing how to proceed against ICANN and Enom, and possibly the TLDs.  

Once the Default is entered by the Clerk of Court for the Middle District of North Carolina, the next step will be to prove damages against the above Defendants.  On behalf of Plaintiffs, the Dummit Law Firm will continue to work closely with micro- and macro-economic experts in order to fully ascertain the extent of the damages caused by RegisterFly and others.

As members of the Class we represent, you will be called upon to fill out information about the domains you lost and the economic harm you suffered.  We are still working with our experts to design the appropriate questionnaire to facilitate such a vast amount of information.  We will contact you with any further information as soon as we are able.

It's highly recommeded that everyone gather and organize their evidence of losses because there is more than likely going to be a flood of information for this case.  Currently, it hasn't been reported as to how many are in the Class.  As information is released, we'll post it here.

The Goals of the Registerfly Lawsuit

These are the goals of the Registerfly Lawsuit posted on the Registerfly-Lawsuit.com website.  Please take a moment to visit the lawsuit site and sign up if you have in fact sufferred damages from Registerfly.

  • First and foremost to halt the damage and help the hundreds of thousands of RegisterFly domain name owners regain control of domains they have purchased and registered through RegisterFly.com.
  • To stop RegisterFly.com from continuing to register new domains even as they fail miserably in their duties to handle the ones currently under their control.
  • To hold RegisterFly accountable for the damage it has caused.
  • To hold ICANN responsible for its breach of duty, ranging from accrediting RegisterFly in the first place to letting them keep their accreditation after they time after time violated term after term of the accreditation agreement, and failed to give adequate weight to the endless stream of appeals for help from RegisterFly customers, all during which time ICANN was collecting a fee for each domain RegisterFly registered.
  • To hold ENOM accountable for its apparent role in withholding authorization codes that were registered during the time that RegisterFly was an ENOM reseller, making it impossible for those domains to be transferred to another registrar, and billing RegisterFly customers, (who were registered when RegsieterFly was an agent of eNom) to provide services they were already liable to provide under their agent's (RegisterFly's) agreement.
  • To ensure that the victims of the gross failures of these entities are justly compensated for their losses.

I just want to confirm that at this point if we wish to participate in the lawsuit that we do NOT contact the lawfirm at this point, just wait for word when the questionaires are available.

Also is there a recommendation of a lawfirm that has been successful in getting back a highly valuable domain that was lost to this registerfly fiasco? I had a couple extremely valuable domains that were impossible for me to renew be bought up by individuals that will not return email or calls. I am willing to invest some money in this, they formed the core of my future business plans.
