Kevin, Stop The Nonsense: Take the Logo Down and Give us the Data

To all affected by RegisterFly, I am very sorry for not having provided an update to the Blog before this. We have not been idle.

We are pursuing RegisterFly as hard as we can. The latest development is that ICANN’s General Counsel, John Jeffrey, has sent a letter to Kevin Medina telling him his ‘time is up’. Read the letter [pdf] for yourself but the key point is he should give ICANN accurate data and do it now. RegisterFly has twice now given us data. The first time it was insufficient. When we pointed that out and asked a second time - guess what? They sent us exactly the same data - insufficient only this time out of date. We need the data to allow a bulk transfer when they have their accreditation terminated.

Secondly, RegisterFly still has ICANN’s logo on it’s website even though we have demanded they take it down.

Kevin Medina is the CEO of RegisterFly.

He claims to be acting in the interests of registrants - his customers.

Every day ICANN hears from yet another registrant (another customer of yours, Kevin) saying they want to transfer away from RegisterFly but there are delays, calls that go unanswered, people put on hold without response etc, etc, etc.

So Kevin, here’s the thing: why don’t you REALLY act in the interests of registrants if you are serious. Stop mucking around with people’s lives and livelihoods. You could allow ICANN to authorise a bulk transfer, today, now, this minute. You could take the ICANN logo down today, now, this minute.

You could stop all this RIGHT NOW….and you should.

We won’t stop pursuing you under the Agreement Kevin. So get on with it.

Go Daddy is advertising on the Phoenix CRaigslist for new tech/sales help. Could it be they are ramping up for a landslide of new domain transfers.

That's a scary thought. ICANN is relying on RegisterFly to provide this data to bulk transfer away??? This seems highly illogical to me. They are expecting the company that they are putting out of business to offer up this information. Right.... I'm sure they are running around the office getting that information together for you, ICANN.

ICANN, you have a very large number of people relying on you to get their domain names away from this sinking ship. How about you step up and prove that you aren't the spineless organization that people think you are.

Vint Cerf, the chairman of ICANN, addressed the Registrar Constituency today in Lisbon. He asked, “At what point should ICANN get involved with a zombie (AKA walking dead) registrar? A few years ago, it was clear that ICANN would get involved in a dead registrar situation, but the line has blurred since then.” To a room full of registrars, it is a question that puts registrars on the defensive, but in light of the RegisterFly situation, the registrars were interested in cooperating with ICANN in this brainstorming session. Protecting the registrants and their domain names is a primary concern and focus of the ICANN Lisbon meeting. During the discussion, the issue of proxy registrations and how they can actually hurt, rather than protect, the registrant was raised several times.

The mechanisms that ICANN could introduce to protect the registrant could involve asking registries to report to ICANN if a registrar is having funding issues. There are early warning signs and red flags, but ICANN is currently not monitoring these signals. The time it takes for a registrant to get responses from the registrar can also indicate the health of a registrar, but registrars are not interested in getting judged or graded by ICANN. ICANN requires registrars to escrow registrant data in its current contract, however this requirement has never been enforced. The RegisterFly situation has strengthened the resolve of ICANN to start enforcing this provision of the contract, however, proxy registrations information is not required to be escrowed for safe keeping.

ICANN is collecting feedback and ideas for the next month, so if you have feedback on changes they could make, I would encourage you to voice them to ICANN.

as of now, registerfly is down from what I can see. So far, my domain which is being held hostage is still up. WTF regfly? WTF ICANN't?

March 31 was the date at which accreditation would be terminated if Rfly did not decide to dispute the accreditation through an dispute resolution provider.

Rfly has decided to do that.

I will post on what this means later today.

That's bad news, people. Things will get delayed...

This is domain napping. I just paid $1,000 to get back one of my domains, which is now in a safe registrar... YET, even now that domain is still listed in my RFly acct as paid up. That means their system is bogus. Time for Dick Tracey to enforce the law against theft and kidnapping.

I am not a legal expert but it would seem to make sense to submit complaints to the New Jersey Attorney General (http://www.njconsumeraffairs.gov/ocp/ocpform.htm) as opposed to the BBB which is like ICANN (Powerless). At least, as seen many times in NY the Attorney General has some teeth.

If Fraud is proven, Medina could possibly end up in jail.

How do we gain control of our stolen, lost, expired (and NOW in REDEMPTION) domains?
Will this bulk-transfer allow those of us who's whois info was illegally changed to claim our names? what happens next? how?

What happened to freezing all expiration / redemption actions on RF domains?

Seems someone is lying to us.

I just lost 1 domain a few days ago and I have 33 other domains with RF. What do i do? Where do i complain? Please help. I may get sued for losing the domain name of a client. This is serious. God help us.
