angry-man.gifThe court ordered Kevin to publish on his website a notice telling people about ICANN terminating it's accreditation as set forth in the preliminary injunction issued on April 16, 2007.  The court has further ordered that Kevin and Registerfly comply with all other aspects of the preliminary injunction by no later than June 1, 2007 otherwise he's ordered to pay $5000 a day until he does comply.

This morning, United States District Court Judge Manuel L. Real issued a Permanent Injunction against RegisterFly.  The Court held Registerfly and Kevin Medina personally to be in contempt of the Court’s earlier Preliminary Injunction Order. - ICANN

While this seems like a lot of money to some of us, it all depends on the cash flow of Registerfly.  A while back we had an insider tell us that the Registerfly website was taking in between $5,000 and $15,000 a day, all of which were for services that weren't rendered.  Still today, there are people going to the site and registering domain names, signing up for merchant accounts, joining the Registerfly reseller program and purchasing hosting services... none of which is being given.  This constitutes Grand Larceny at the least.  Why isn't there an injunction to shut the site down completely?

Kevin Medina has been given the permission to continue defrauding the public and lulling them into making purchases for products he cannot provide.  A slap on the hand... a gentle pat on the ass... and Kevin you can go home now, just let people know you are no longer ICANN accredited before you take any more of their money.  Is this ridiculous?  So there we have it folks, justice has spoken and justice has been delivered.  Registerfly lives on while Kevin and his chihuahua sip on martinis watching the sunset in Belize.  Hello Interpol... Can you hear us now?

I agree with the "Registerflies Administrator" that criminal actions at Registerfly.com do indeed constitute "GRAND LARCENY" and would seem that INTERPOL should be brought into investigate this ongoing "INTERNATIONAL FRAUD"

If they don’t fully comply with the Preliminary Injunction by June 1, 2007, RegisterFly (or Kevin Medina personally) is required to pay $5,000.00 per day until they do. As the Court previously ordered, Kevin Medina did personally appear in Court today, as the Court had ordered.

He acknowledged that he understood the Court’s order.

I think the problem is as you pointed out, that $5000 may not be enough to inspire Medina to action. And even if it does, one has to wonder the extent of follow through or if he will 'marginally comply'.

Another thing, I think the judge may think this is a princely sum compared to a few domain registrations at $8 each, but as you put it in all reality it may not be.

We can hope that by Sunday night we have at least a sign...

Let's hope that GoDaddy and ICANN actually tell us the process we can use to claim our domain names - those with the right contact info, those with the ProtectFly junk and those that have either "disappeared" or expired due to RF's failures.

Not to mention the fact that we got a whole pile of Authcodes out of RF this past 2 weeks (about 16 of the 20 names we still have stuck there) and started the process to transfer but haven't seen a single transfer approval/disapproval email out of RF in ten days now. Hmmm.

According to the Preliminary Injunction dated 26 April 2007, paragraph 11 (page 5):
" . . . a notice that must appear in the top third of each web page, must be in 14 point bold typeface, . . . ."

He is clearly still in contempt. $5,000 per day is obviously not enough. Write to The Honorable Manuel L. Real, United States District Court Judge, Central District of California, 312 N Spring St, Room 529, Los Angeles CA 90012. It seems that only many of us writing will help the Judge to understand the scope of the problem.

Not only is the notice placed in an obscure location, it has been intentionally formatted so as to be virtually unreadable -- with the line spacing set at about half the font size so that the lines intersect horizontally.

An illegible notification in my opinion does not constitute compliance with a court order.

Guys help! I just registered for a domain at registerfly.com on May 30th! I had no clue about this and only noticed when my tickets were unanswered and I went to the customer support page!

My domain worked for a few hours bu not stopped working and I dont know whats going on. I cant register it anywhere else because it says it is now taken.

Also for some reason there is no whois information on it at whois.com; it gives me some sort of error. What do I do?

I am a scambaiter and like to mess with Nigerians and Romanians that are trying to rip people off and Kevin is no better than them... I could smell this was a scam a mile away.

The worst part is that Kevin will get off scott free and as soon as someone steps in to force registerfly off the net, he will open some other website up to rip people off... just wait and see.

Festus, I wrote just about the exact same thing in another thread today before seeing your post here. You could not possibly be more correct. This is actually what is going to happen. I've seen this same thing over and over again and again with business people in this country. This is quiet normal. Kevin will indeed just move on and set up yet another scam. Give him a year or two, maybe even less, and he will be back at it, business as usual, scamming more people. Once a scammer always a scammer. And the law is not going to do anything about it. I, on the other hand, am currently being evicted from my apartment because I lost so many clients and this entire thing literally ruined my business. I tried to open up a new business, to replace my web design business that Kevin destroyed, but I didn't have enough resources to make my new business fly (no pun intended). My landlord doesn't care what caused all of this; the only thing he cares about is getting his money. I can't get away with the kinds of things that Kevin is getting away with and I am having to pay for what he did to my business. By this time next week, I'll probably be homeless because of all of this. I’ve already received my notice from the landlord and have no way out. And there is no legal protection for me, and absolutely not one single soul out there who really cares. There is no help for me. By next week, hell, I probably won't even be online anymore. My internet is also getting shut down - any day now. Kevin stole money from me, he caused me to loose credibility with all of my clients, he caused my clients domains to go offline and their sites started resolving to parking pages with ads that promoted services that were in direct competition with my clients. I’m sure you can appreciate how upset that made my clients. My clients pulled their accounts with me and went to my competitors. I lost my income because of this. The entire situation is just screwed!

AJ, I feel your loss, just like my own loss, that's why you have to join in the Class Action that is held by the NC lawers, maybe you still get some back in the end.

And yes, you're right, it's sad to see that outsiders don't care, ICANN doesn't care and all of the rest, they don't see what you and I and all others who are in the same boat as us have to go through.

The biggest and sadest part is, if you have a name and do a criminal act here in the USA you may get a pardon from Bush, just like Scooter ;)

But we with no name can go to hell!
